EVENT – INTERNAL WORKSHOP OF HUMAN RIGHTS AND SOCIAL CONFLICT ISSUE IN SINARMAS FORESTRY OPERATION

Human Rights aspects in Forestry Industry operations, like SINARMAS FORESTRY, and in the efforts to realize an investment are very complex. The complexity in Indonesia is generated by the numerous bylaws that regulate the obligation to fulfill the Human Rights concerns. Although the fulfillment of Human Rights have been elaborated in the bylaws, however, it would be far from adequate to satisfy it merely from legal approach – moreover as it involves the interest of public rights of the indegenous community surrounding the industrial or investment area. There have been strong perception on the imbalanced relationship pattern between the company and the surrounding community, where the community is always perceived as ‘powerless’ (weak) to object over power of the company (which in many cases are marked as the ‘villain’ when facing such a community), despite the fact the company has done everything in accordance with the law and the legal contract. It is not rare that conflicts related to the fulfillment human rights cannot reach an agreement, although all legal aspects have been run. There have been cases where particular parties intentionally sparked a conflict to create chaos as means to get a bargaining positioning. This proves that conflict resolution would be far from being sufficient through mere legal approach. Instead, it needs comprehensive identification and mapping of the conflict and at the same time determine the best possible solution. The gap between the regulations and the facts found in the field cannot be solved under normative resolution. It needs evident tricks and orders to create harmony between the company and the surrounding communities. With the above situation, it would be wise to comprehend the Human Rights approach in Indonesia through “INTERNAL WORKSHOP OF HUMAN RIGHTS AND SOCIAL CONFLICT ISSUE IN SINARMAS FORESTRY OPERATION” in order to minimize conflict, avoid human rights violation and maximize every opportunity to realize a sustainable development, for both the company and the community.
